Not sure who as all the companys that have released it went bust. However it will be an asset belonging to someone. Which could be enough for the management to say no even if they were looking for an excuse to stop it.

Hi Quoincidence, I don't want to be a downer on an amazing project, I'd love to see it myself. If the management do get wind of it and surely they could from this board, then they could sue you for breach of copyright. Even if you charge nothing. Unless you have the rights to this material, that is the risk you run.

I would gladly pay for a better copy again but if the band won't release it (Even though there is a definate market for it). Maybe it would be better to send copys as friends. I can see this has been a labour of love for you Quoincidence. A big reveal at a convention could lead to a lot of trouble. It's wrong of course but copyright is a minefield. Of course the risk you run by giving away copies is that someone else copies it and tries to sell it as their own work.

A work is in copyright for a specific amount of time. And that depends on the type of work. A work is in copyright whilst the creator is alive and then for a set period after their death. Literary, artistic, musical and films for 70 years after death of creator (s). Broadcast material for 50 years. A work is only out of copyright if a) the creator puts it in the public domain. Or b) when the rights period expires. And I don't believe this message board is the public domain. Even though anyone can read it. I'm trying to establish this for certain but from my understanding of the public domain it isn't.

I have the dvd that DB made. Both the two VHS-parts and the private filmed missing bits...
Wasn't John Eden's work with RAOTW a labour of love? Or is SOMOGAG gettin' some??

It was but he asked the band for the master tapes when they were found. They didn't mind him doing it as i suspect the re-releases were in the pipeline anyway. I have seen that other DVD of EOTR and I don't like it i'm afraid the private filmed bits are too poor qaulity and distracting.

The band still had to give him the permission to do the work. Without that, he could have done it but not released it. As Lord Flash says, the band handed over the tapes and they knew what was going on.
